Succession

Unless you took over your tenancy after someone had died, the tenancy will automatically pass to your husband or wife who is living with you when you die.

If you have no husband or wife living with you when you die, the tenancy can pass to your partner or another relative, if that person had been living with you continuously for the 12 months immediately before you die.

If the tenancy has already been passed on once, under the law, we will also allow a husband or wife, or a person who has been living with the tenant as part of his or her family for at least 12 months immediately before that tenant died, to take over the tenancy.

However, no other person has the right to the tenancy and the property must not be specifically designed or adapted for a disabled person to use, or be too big for the person who wants to take it over.

Assignment

If you are leaving your tenancy on a permanent basis, and did not succeed to the tenancy, you must ask us, in writing, if you want to assign your tenancy to a member of your family.

That person must have lived with you for 12 months prior to the date of the assignment, and be able to show that the property is their only or principle home.
